A class action settlement of $277.7 million was approved by a Federal Judge to solve the claims regarding 2014-2018 Nissan Rogue, 2015-2018 Nissan Pathfinder and 2015-2018 Infiniti QX60 vehicles with faulty CVT transmissions. While this might sound like a large settlement, the reality is owners of vehicles impacted by these transmission defects usually would do much better opting out of the class action settlement and filing an individual lemon law claim.

The most common CVT (Continuously Variable Transmissions) issues reported in Rogue, Pathfinder, and QX60 vehicles include premature failure, hesitation, jerking, juddering, lurching, revving, shaking and stalling.

The settlement amount should allegedly cover warranty extensions, reimbursements of transmission repairs as well as attorney fees and administrative costs for close to 2 million vehicles. Owners and lessees of affected models will have the option either to exclude themselves or object to the settlement. Again, individual owners in California will usually do far better with an individual lemon law claim which has far greater damages than this proposed class action settlement. Many people believe class action settlements like this one are used by car companies to shield themselves from having to buyback defective lemons pursuant to state lemon laws.

Another hearing is scheduled on May 23, 2022, to confirm final approval of this settlement deal.

The case is Stringer et al. v. Nissan of North America Inc. et al., case number 3:21-cv-00099, in the U.S. District Court for the Middle District of Tennessee.
